Trust Administration

We help clients with their estate planning and the preparation of wills and trusts. We also help clients when a loved one dies. If a loved one owned assets in the form of a trust (funded with their assets), it is likely that no court-managed administration is necessary, although the Successor Trustee will need to administer the trust and make distributions in accordance with its terms. In situations where assets are not held in trust, then a court-managed process known as estate administration or probate administration may be needed.

We provide services in the area of Trust Administration including, but not limited to, the following:

  • Preparation and giving notice to beneficiaries/interested persons of death and existence of trust
  • Completion of trust funding
  • Inventorying of assets (including obtaining appraisals when needed)
  • Dealing with creditors
  • Assisting with preparation of accountings
  • Providing information to beneficiaries of their rights under the trust
  • Distribution of income
  • Distribution of assets
  • Beneficiaries determining their desired asset distributions
  • Tax planning associated with trust administration
  • Payment of trust administration expenses
  • Sale of trust assets
  • Payment of estate and/or inheritance taxes, if applicable
  • Petitioning the court for authorization or directions relating to the trust, when needed
  • Final asset distributions
  • Obtaining receipts from beneficiaries at time of distributions
  • Final distribution of assets to beneficiaries
  • Disputes relating to entitlement to assets or distributions under trust

We have assisted clients in the administration of trusts during lifetime and also the administration of trusts following the death of the first trustor/settlor to die or after the death of the second trustor/settlor to die. We have also assisted clients that are beneficiaries of trusts in understanding their rights as well as the obligations of the Trustee of the trust.
